I am questioning how the C rating of Li-ion batteries is determined?

Is the C rating based on nominal charge/discharge rate or maximum charge/discharge rate?

any thoughts would be appreciated.

I belief it's the rating the manufacturer wants to apply. The lower C rating normally is specced for more cycles. The same as lower discharge level seems to provide more cycles. The maximum C for the short term can be as high as 3C for some batteries. 

Just today I saw a 7Ah battery where the BMS only switches of at 40A.
