hello 

in off grid inverters .. could we take full load capacity from inverter with full charge capacity at the same time?

for example: 

in 5 kw inverter; if there is utility and we charge the battery with 5 kw .. is it possible to run 5 kw load.. at the same time? 

or we need to use ATS panel to change over inverter and utility?!

A 5 kW inverter might not be able to charge the battery at 5 kW; let's say it's 3 kW max. If the inverter is in battery mode, then a load of more than about 2.5 kW would deplete the battery, as the load plus losses would be higher than the charge power. But you can usually run the inverter in bypass or line mode, meaning that the utility provides some or all of the load power. In that case, you can usually run full load and full charge power at once. But note that this requires that the AC-in wiring and breaker is up to the task. Often it would be, but in some cases it may not. If you're in control of the installation, you can ensure or insist that this is possible.
